Our subdivision is not a condo, would we still be governed under TN horitzonal act that relates to condominiums. These are the only laws (outside our bylaws) that I find in TN.

I recall a posting (I think from DonnaS (in TN)), who stated that if the Association was not a condo, then the only laws that would apply would be:

TN Corporate laws (if the Association was incorporated in TN)
Contract law (the contract being your CC&Rs)

You should check with a local attorney to verify this.
