I am the VP of a HOA in San Antonio TX.

I have had several homeowners ask me for emails between the BOD about a specfic topic that is coming to a Special Meeting. Our by laws say everyone has the right to any documents, are these documents? Or since they are "my emails" can I share them anyway? Thanks so much

It must be one "hot" topic. You really might want to talk to your assoc. lawyer about this. I do know that the entire email thing is something new to deal with as far as openness. Board members must be very careful what they write because I do believe, at least in some states, that they are public information.

I've seen some board members make some pretty inflammatory statements in emails, opening themselves up to lawsuits.

If you are having a special meeting, then you must provide notice of the meeting to all members. It should include the date, time, place and the purpose (what issue is being discussed) of that meeting.

Michele, we print and file copies of all HOA related emails. Emails you send to other Board member definitely are part of the association's business. We do not arbitrarily shave these, rather we follow the association's Rules and Regulations on viewing and copying association documents.

If you wish to share "my emails" I suggest first sending an email to other Board members stating "I plan to share ______________ emails with ____________ members unless I receive an objection from a Board member in the next ____________ days. The reason(s) I wish to share this information is _________________________________________________ .

That has already been done, but thank you. I have owners wanting to see the emails before the meeting takes place,as they have the truth in them.

Something to think about. But I can say this, the other two will say no as the truth will be seen if it happens.
