I was just elected as our HOA President and I have a question regarding the power of the board. If there as issue comes to the board for a change in our community, i.e., speeding signs, parking signs, landscape issues, services that need purchased ... etc. can the board act upon these without going to the residents. This is just a general question as I currently don't have issues. I just know there will be a case where something will come up that requires some attention which most likely has a fee associated. Granted I know if there is a major change in or community such as erecting a new park or changing some common grounds, those should be voted on by the residents. But what can the board itself vote on and complete? Where is the line drawn before a board should get a vote from the residents?

Threshold of Board spending of community funds may be outlined in your governing documents. Have you looked there first?

There is no threshold. In the past it seems as if it was a juudement call when to include the residents. But once I think about it, all meetings are open so the residents are already included, they just don't come.

Generally the board is elected to run the day to day activities of the association. My feeling is once a budget is established and approved and those expenditures fall within the budget then it is normal business and is the boards responsibility. With that said, it is probably the proper and right thing to do with any major purchase or something that changes the look of the neighborhood to solicit and listen to homeowner feedback.

Your bylaws should spell out the duties and responsibilities of the board. Study them carefully and you will understand what the board can and cannot do.
