Our Covenants require each owner to replace their unit Siding at their expense.
The HOA is charged to maintain uniformity of the community via Architectural approvements.
Question # 1: If one or two units of a multiple unit building has problems with their Siding and decides to replace it with the same original Siding that is 20 years old, it will not match the adjacent units. Can the HOA require all units in the building to replace their Siding at the same time to maintain uniformity ?
Question # 2: During semi-annual community inspections the HOA finds Siding deficiencies in one or more units of a building that adversely impacts the value of all units, can the HOA via Sepecial Assessments replace and bill if the unit owners don't agree in order to maintain uniformity and property values?

A: I do not know, but seriously doubt it. You would have to site your Covenants or a definition of ‘uniformity’.

A. Not sure what you mean by ‘siding deficiencies’. Your justification to impose a special assessment seems just a little too ambiguous.

I would think the best solution for the long run would be to amend the covenants to state the Association will be responsible for repair and replacement of the siding. Otherwise, these problems may not go away.

Or, perhaps you could try to get a package deal to replace the siding on the entire building(s). If you can show substantial savings per unit would the owners be more inclined to replace the siding? Only you would know.

Is this masonite siding? There were lawsuits involving some types of masonite siding that was used in the years past. NOT all masonite siding is eligible for replacement. Plus I believe the expiration limit has expired a few years ago on this. You can still buy masonite siding and use it. It's just the kind for several years ago that was found to be defective.

Plus watch out for scam artist who use the "Masonite siding" sales pitch. It is a scam for the most part. There's about 10% truth to what they say but the other is just to sale you their product. Which may or may not be in conformance.

If this is other type siding, then the ACC needs to have input on the situation and it discussed with them FIRST. Find out what they say on the subject on replacement. They are the best resource before you go shopping....
