Our association fees just went up in addition to a "special assessment". Our lawns are brown, and the water pipes have broken 5-6 times within a month. Do we have legal rights to hold assessment fees?

I doubt you have the right to withold assessment fees. They are paid for your benefit to your association. So in essence, you are paying them to yourself. I would however find out why the fees have suddenly spiked (have you looked at the budget or financial statement?) Some associations never raise their fees, and suddenly one day realize (usually when a new Board is elected) they are severely underfunded.

Also, if the pipes keep breaking, is it due to mainetnance or an inept contractor? Too mnay associations just fix it, pay the bill, and never ask what happened.

We feel the money is not coming back to us since it is being spent inappropriately, and possible cut backs have not been forthcoming. (I was once on the Board and have reviewed the figures.) For instance, why not obtain a business license where materials can be purchased for less? Single trips to Home Depot are made at random where huge prices are paid for everything.

That is the local chapter for Utah, but there are CAI chapters throughout the country. I would suggest using the CAI as an educational resource for your HOA. It is as close to a regulatory body as there can be.

Sorry mam you are wrong about Home Depot by an large they are cheaper than wholesale houses. I am an electrical contractor and we buy everything from The Depot. The only thing Supply Houses are good for is allowing contractors to run up a tab.

The only thing HOME DEPOT is good for is bulk garbage at a 'cheap' price...............

eg. contractor 10 pack of duplex receptacles for $3.34 (yep, 34 cents each)

try comparison pricing 'Pass and Seymor' equipment (if you can even find it at HD)

Sorry, but I must disagree with you. CAI can qualify as an educational org, but it's hardly a regulatory agency and I doubt any CAI official would say they are. I think what Sandy is looking for is a state agency which regulates HOAs. I don't believe CA has one.

MaryA is correct. There is no agency in CA that will help you. Nada, Zero Zip And as BradP says, pay the dues and fight after, they can take your house.

Dues can be raised a maximum of 20% a year and a special assessment cannot exceed 5% of the annual budge unless voted on by the members.

JaneK, and everyone else, it got to the top of the list, along with a handful of other VERY old posts from people who obviously no longer post and/or visit the board because a new person is Spamming the forum to drum up business for his organization:

His posts are one or two comments in length then they encourage the (long gone) original poster to contact him directly and he posts his phone number and email address and sometimes his company name.
