We're getting ready to implement a parking permit program - 'cling'-type stickers for each car (limit 2 per unit) and a rearview mirror hanger for visitors (one per unit).

Does anyone have a sample R&R statement they would be willing to share as a 'jumping off' point? I'm responsible for drafting this document and would love any input/jumpstart docs.

Are you going to update your CC&R's? This seems to be an item that needs to be in the CC&R's and by-laws. It's a pretty big item/issue. Make sure you add punishment/fines when you create the new addition. It's one thing to say it's a violation but another one NOT to have a fine system setup. Which has to be in accordance with your STATE's laws. They have limits on such things as interest or fines charged. It falls under the "Loan sharking" type statutes.

It's good to have your i's and T's crossed before implementing this kind of system.

Thank you for your input...especially the point about 'fines'...didn't realize the State laws should be considered.

I do foresee this as a change to the by-laws. Unfortunately, I'm starting with a black sheet of paper...LITERALLY, so am really hoping for any sample documentation someone can share with me that I can review to serve as a foundation for writing our version of 'the rules and processes'.

It would NOT be a change to your (corporate) bylaws!

It would be either:

a) a new rule / regulation (check the covenants and restrictions for 'authorization')

OR

b) a change to the CCR's (would require an owner vote)

if this is not 'crystal clear' you need to consult with an attorney well voiced in HOA / not-for-profit law

As a reminder, if you are going to use towing as an enforcement option, you need to check with your County to see what rules (signage, notice, etc.) the Association needs to comply with prior to towing being done.

Ours is a Private Community and we own all our roads, including parking areas. We considered the tag process, but when the discussion come down to who would do the enforcing, and the possibility of someone forging the tags, etc. we decided to do an amendment to our Covenants and assign two parking spaces to each homeowner by lot #. (by lot # to keep the address private) The assigned spaces are not the property of the homwowner, but they are the only ones who can park in them.
The homeowner notifies the MC of anyone parking in their spaces, we run the tag# and after one warning the vehicle will be towed. $250.00 per tow plus $50.00 a day inpoundment fee keeps everyone honest.
Our community struggled with the parking issue for years. Children living in the community grew up and purchased their own cars finally led to one household having four or five vehicles.
Assigned parking I think would be the best way to go, if your community owns the property, and the Board of Directors are responsible to maintain the common areas.
The tag system would be very clumbersome.

James - How do you run tags in Maryland? In Virginia, I don't think that it can be done, unless you're a law enforcement officer.

There are reputable (albeit not that many) tow companies that will give you the parking permits for free and they will monitor the parking at no charge. Their parking parking are very difficult to forge.
