The HOA is in Florida. Two members (not married) but own the home want to run for the board at the same time. Is this possible. Our Bylaws say that each lot has only one vote for a Board member. Your feedback is appreciated.

Richard,

If your governing documents does not have anything limiting how many from one household/lot may serve on the Board - it would be allowed. However, I don't think anyone on this board would recommend that it be done.

The one lot - one vote issue only applies to items that the membership votes on. For a Board of Directors, each Director has one vote.

Richard,

are both named on the deed? If true, both can run. Can you please quote the By-laws? Something does not sound right.

Richard...ok, first step since they are not married are they both on the deed? If so go to step two, what do your documents say about members from the same household being on the board at the same time? If they say nothing about it then it is legal, what you quoted above I am assuming refers to the procedure for voting for board members.

The other way to look at this go back to step one, if they are both not named on the deed then go to step two and see what your documents say about non-members being board members and if it is allowed.

your fortunate to have even two people interested in running for the Board. Why is this a problem, are they joined at the hip and parrot oneanother in their views?

My thinking is two board members cannot own one lot. Why not run the wife/hubby/kids and create a board majority?

Board votes ARE votes that represent the membership of the HOA. One vote per property. If not in the by-laws, then the board can pass a policy since it's not explicitly outlined.

Kelly...unless your documents speak specifically to the qualifications of a board member they can be from the same house, potentially husband/wife/kids all on the same board. The one vote per lot typically refers to the member's only meeting and not the board of directors. two totally different entities

Not really. Here Chapter 720 prevails. Every member can run as long as 18 years old and not a felon.

Kelly - you must define "Member". Then you must look in your documents to find the definition of the qualifications for board membership.

The vote from one household is a totally different thing.
