Here's the problem. One board member excuses himself before the meeting is over. He has done this every time we have a certain member address our board (about 4 times now). The board member and member have had disagreements on rights of members ( ex. members speaking at board meetings). The board member leaves about 2/3 thru the meetings. Does this break any codes?

I don't think there's a law being broken, but it's very unprofessional - board members should arrive to meetings on time and stay until it's adjourned. If they will be late or need to leave early, they should say so in advance and provide a reason. Why hasn't your board president talked to this board member about this?

As for members speaking at board meetings, our board meetings have a resident forum at the beginning (about 10 minutes or so) -afterwards, they can stay and listen to the proceedings, but aren't allowed to comment or ask questions until after the meeting is adjourned. We haven't had any problems with this since I've been on the board - maybe this could work for your community.

Randy, here in California, members must be allowed to speak at Regular ("Open") meetings. But, the board doesn't have to let them speak during the business portion of the meeting. Like, Sheila, we have Open Forums before and after we conduct HOA business. works for us too.

It appears that one of two things are going on. 1) The meeting is running longer then the person planned on or 2) there is a personality conflict between the two individuals. No matter which one it is, the Director isn't causing a scene. They are just excusing themselves from the meeting.

If the reason is due to a personality conflict, this is probably the best thing the Director can do. It allows the meeting to continue and avoids any public conflict or words being said.

If the reason is due to the meeting running long, perhaps the President should hold more meetings or minimize the discussion on certain topics. Committees can provide written reports. These things can minimize how long meetings are. I try to limit the meeting to 90 min. max with a goal to be out in under an hour.

The only concern the Board should have would be any quorum requirement. If there is no quorum when the Board member leaves, business may no longer be conducted.

in kansas we are required to give members a "reasonable" opportunity to be heard on matters concerning the association at our board meetings. I do think the behavior is childish, the president of the association needs to step up and get to the root of the problem. I am not aware of any codes being broken but it needs to stop.
