Our building is undergoing painting finally! It's an exciting time. Our building is in big need!!

Our BOD has worked with a local vendor to contract with us to paint out huge huge building. THere has been some fairly nice color schemes selected and a few walls on our building have been painted to look like The Partridge Family Bus... in a good way to look hands on at the colors. Nothing has been selected yet and as with any HOA I suspect painting won't commence until after the New Year.

There is a poster in our lobby telling homeowners about the 5 or so colors selected to look at. THere is also a notice that homeowner's if they wish "may come to our next HOA meeting" and offer their opinions for consideration.

BUT?? I have had several neighbors say they are shocked we are not voting on it, and why would we wish to come to a meeting and "offer an opinion" ??

I know that is a valid issues, but also? SHouldn't of this been done by our Archtechual Committee?? Our ccrs state in changes in our builiding require a vote from our membership. Grant it, this is just a coat of paint, but it is a change.

DSA? I dont' find anything specific. Thanks.

I also forgot to add, that our building is a country blue grey, the colors selected are primarily in the same family of hues, ranging in dark to lighter except a brilliant yellow.. Similar to the yellow on this page... to the left of this box. ( the on with websites adverts! ) Its shocking, really our BOD could change the entire color of the building, but only offering homeonwer's opinions. Our BOD, has the ability to vote whatever it wishes, taking into consideration if it wishes the input of the membership

I know when we (the Board) decided to paint the exercise room there was no input from the H/O's. It was decided that the exercise room was one place we could do away with "institutional eggshell" and it was painted a light blue. Now the first coat wasn't even dry before we got an email from the wife of one of the Board members. How could we? We're ruining the complex! etc, etc.

Six years later the exercise room is still light blue and we had a total of ONE complaint but several complements over it. The fact of the matter is that humans are highly adaptable and that something considered "hideous" at the time simply fades into the background.

I guess the question was overlooked. Can the board indeed change the color of a building without a homeowner's vote? They can't seem to do anything of that nature otherwise ( we removed an unsafe rotted wooden structure a few months ago.. in order to replace it , it required a vote... form the homeowners. )

This didn't seem to apply but i was asking if painting a different color requires a vote? I can't find on our DSA site.

As Glen pointed out, decisions are typically left for the Board unless there is something within your governing documents that require the issue to be brought to the membership for a vote. If the governing documents are silent on the subject (and there is no State or Federal law addressing the issue) the Board may choose to bring an issue before the membership but isn't required to.
