PLEASE ADVISE ON THE PROPER PROCEDURES ON AMENDING THE ORIGINAL HOA CCR'S IN FORNEY, TEXAS. OUR HOA HAS SOME HO'S PROPOSING AMENDMENTS TO VARIOUS ITEMS IN THE ORIGINAL DEED RESTRICTIONS REGARDING OUR SUBDIVISION.

ANY AND ALL HELP WILL BE GREATLY APPRECIATED.

in general, the methods to alter your CC&R's can be found in your bylaws. Amending deed restrictions is beyond my knowledge.

i would be completely surprised if you don't have by-laws... how does your HOA know how to hold elections, classify membership status, describe when and how meetings must be held, describe proper notice, and appointment of officers, comittees, etc.? How does your HOA manage to do business without bylaws to follow?

i guess it's possible to have an organization without bylaws, but it would be odd.

OUR HOA WAS TOLD THAT THE CC&R'S ARE THE BYLAWS. REGARDLESS, I FOUND THE ANSWER I WAS LOOKING FOR BUT DO APPRECIATE YOUR TIME AND COMMENTS.

one thing i learned a long time ago, don't believe everything someone tells you. ask for proof.

CC&R's are the rules the owners must live by. By-laws are the rules the organization of owners (the HOA) must live by. they are/should be separate documents.
