A while a ago I posted about being called to testify in a lawsuit regarding excessive fines. The ex-resident was suing the HOA alleging he was signaled out for fines due to a bias on the board. As an ex-board member, I was in possession of emails between board members that supported his allegations. I said I would let everyone know what happened...
I never got the chance to testify- right after the HOA President testified the HOA attorney consulted with the Board (a quorum was in attendance) and came back with an offer to the ex-resident: drop all fines and collections, drop any requests for attorney fees and to send letters to the credit bureaus to rescind negative reporting. I think the HOA President sounded so biased that even the HOA attorney knew it was time to cut and run.
So- 100% defeat of the HOA and their biases toward this resident. A good day for Lady Justice.
It is too bad the HOA took it to this extent- even though the HOA does not have to pay the ex-resident for its actions; they racked up thousands in unnecessary legal expenses.
