I live in a condo community, about 5yrs old now, we are in the process of establishing a BOD and a HOA Association.
My quesion is what is the duty of a BOD and is that different than the HOA Association which I think includes President, Tresurer and Secretaty. Can anyone explain this to me?

The Board of Directors would be a group of persons elected by the membership to make the basic decisions about the Association (what contracts to sign, rate of assessments, etc.). These are the people who are responsible for the running of the Association.

Officers of the Association, President, VP, etc., are typically appointed by the board to implement the decisions of the Board. The Officers would also deal with the day to day tasks of running the Association. The Officers may or may not be assisted by a management company. Typically, the Board will appoint the officers from amongst the elected Directors.

A condominium would need to comply with the GA Condominium Act

An Association would need to comply with the GA Property owners act.

Both would typically need to comply with GA non-profit corporation code (unless the association is incorporated as a for profit or in another State).

Please use the services of an attorney versed in HOAs and turnovers from the owner/developer to guide you through this.

Your questions are so basic that it really sounds like you need professional help to guide your group.

Susan, good question.

I was of the opinion that the OP wasn't involved in the transition process beyond being a member of the Association. However, this might not be an accurate opinion.

Ivy,

If you are part of a committee that is assisting in the transition from developer to members I agree with Susan that you need to get some good legal advice.

If you are just an owner of the unit and are trying to understand what is going on, this forum and websites I suggested in your other thread will be of assistance in helping you understand what you are a member of.
