In our HOA , one director is talking about replacing floor trusses. Is this something for which the HOA is responsible, and considered a common area, or the homeowner's responsibility? The covenants say all areas not designated as lots shall be deemed common areas.

Oh, I see said the blind man...Sounds like some director wants to put a cost onto the HOA...A LOT is what technically owned by the homeowner. The house just happens to be the size of the lot. It's everything outside that lot that the HOA controls. Which means that EVERY member/owner has access to and responsible for it's maintenance/aesthetics.

With that said, are you in a condo with several stories? Are these individual homes? What exactly is the set up that these trusses would effect EVERY owner if not replaced? That is the question. That's because a majority of the owner should agree that the floor trusses are a problem and yes we need to address them. This is true even if found it's not common property. A majority may feel it is common property (at this time and space) and that it is a HOA responsibility. The reality may be quite a different story.

Until we can get a better definition of the set up, it sounds like it's up to the individual homeowner's to be responsible for. It's up to them to decide if they all want to make it a "group" thing to fix it.

You may have to read article(s) which specifically address ‘maintenance responsibilities’ of your HOA.
