What do you guys think about realtors serving as board members when there is a clear conflict of interest here.

I have been denied 2 different requests that affect my property value of my town home. How can a realtor be kick out of the HOA?

A conflict of interest, for Associations, is typically defined as an individual or individuals who, contrary to the obligation and absolute duty to act for the benefit of the Association, exploits the relationship for personal benefit - usually financial.

What has happened that has you to believe that their is a conflict of interest?

Were the requests denied because approving them would violate a covenant or guideline?
If you care to share, what was the request and the reason for the denial?

Unless the HOA is voluntary, an individual is a member for as long as they own the property.

If your asking how do you remove or prevent someone from serving on the Board of Directors, you could try recall the individual or you could run against the individual int he next election.

Is the developer still in control of your Association or do the membership have control of the Association?

I think a realtor serving on the board is great...I see no reason for them not to serve. They get higher commissions based on higher property values so they have an incentive in improving the community.
