So, it seems that I have two directors that are unhappy with the rest of the Board. They are using a known member household to instigate a recall over ridiculous claims. What concerns me the most about this is that their attacks are really against me, the President. They have sent our recall notices using the Associations Corporate name and then having the return of the votes sent to the Associations mailbox.

Has anyone else run into a situation like this?

Why are the members unhappy? What are they claiming?

The Board approved, unanimously, upgrading our cameras in the pool area (30% of incidents happen there). Now, however, I have two members that are unhappy with me because I am following the rules where the previous Board did not. They are using other members to incite a campaign to recall the entire Board. The other members, which are known to hate cameras anywhere (including Walmart parking lots) are being used to create letters of anger and to try to instill unjust actions by the Board. The underlying agenda, is that these directors want, emphatically, a management company to run our small community - 50 units.

I have followed up to all of their letters, in an appropriate way, and they are still not happy. Now they are starting a Recall Committee. It gets better! They sent off their letters using the Associations return label and having their letters returned to the Association mail box. This is confusing the members thinking it is real Association business.

Which rules are you following that disturb the other two directors? Something to do with the pool cameras? Or not?

I'm still confused. Are you saying that the board voted unanimously to upgrade the cameras at the pool, but now, because two board members hate cameras they don't want you to use them? Why did they vote to upgrade the cameras in the first place? The picture is still fuzzy here.

Bruce, I am also confused to say the least. These two directors (one recently resigned) are using the camera issue to instill anger with two members that hate cameras. This is the face view to try to get a recall to get them and their associates into office. My speculation is that since they are determined to get a management company in, they are formulating lies and they are attempting to get members upset so they vote to oust the whole board. Then they can bring in a management company.

The issue I am currently concerned with is the letters that went out to the members. They are using the Association name and address (appears to be official Association letter) on the return address label, then the proxies are being sent to the Associations mailbox.

I can only say that I do not believe they will be able to pull this off as there are too many smart members in our Association and they are not going to get the wool pulled over their eyes.

What is tough with this is that one of our current Directors is part of this recall committee. So when the Board is discussing this recall, I know all of our information and concerns is being passed back to the recall committee.

It is just a mess and I cannot wait to get over this.

When I opened this topic, I was not sure if there was any other association that had a similar situation with an active Director also active on a recall committee. If so, I was looking for their insight on handling the situation.

Unless the entire board approved the letters going out (ie, motion, discussion, vote, etc), then yes, the use of the association letterhead/mailbox is wrong. that's a potential crack/hole in their plan to overthrow the board. I would call a quick meeting of the board, and deal with that issue. Something of that nature should be in the official minutes. Or, a motion denying the entire process should be made, and placed in the minutes.

This is still very bizarre to me.

As I understand it, the pool area already had cameras and everything was fine. Then the board votes unanimously to upgrade something they already had (the cameras). After that, two board members, who already voted to upgrade the cameras, go around stirring up trouble by contacting two homeowners who hate cameras, but were apparently OK with them before they were upgraded.

Something's missing here.
