1. has this method been successful?

2. we have separate by-laws and ccr's. fining and towing are spelled out in the ccr's. can booting be added by the bod to try to bring the costs down to violators?

I wouldn't worry about the cost to the violators. They can bring the cost to zero by not parking in illegal spaces.

A sign should be placed that states the phone number of the company to reclaim the vehicle, along with the maximum tow charge and the amount per day storage.

The tow companies probably have this type of decal that can be placed on your sign.

Our sign says MAXIMUM TOW CHARGE $500 + $15 PER DAY STORAGE.

Perhaps we should add: Save Money -- Don't park here.

If booting is not covered in your CC&R's then the board can not amend it to add booting. Only the membership can.

I've got to agree with that one.

A couple yars ago, before I was on the BOD, there was a speeding problem on our main street (a public street). A member of the city police department is also a member of our HOA. The board president asked him if he could set up radar and write tickets. He replied that he could but he would likely catch many of our own residents. The president told him he didn't care who was speeding and who got caught. I would have said the same thing.

Hi – My HOA is in IL and we do not currently have a towing policy, although our R&Rs do address parking and spell out an enforcement process with a tiered fine structure (which is pretty hefty!). I am assuming that your illegal parking problem is on HOA owned property and that the area is posted “no parking”. In IL, it is my understanding that we (BOD) may adopt a towing policy –the towing policy would be drawn up by our attorney and sent to all HOs with a notice of a 30 day comment period and an opportunity to comment at a BOD meeting. Once passed, HOs would be informed of the policy and effective date. Signs would need to be posted on HOA property at entrances re “parking only for HOs” – or “no parking” (depending on area) and include the info stated by William above. While I have not checked, I think that we could develop a “boot” policy similar to a towing policy. So, I would suggest looking into it, if that is what you want. But, I am curious - if you already have a towing policy, why would a boot policy be desired? Seems to me that the issue is unwanted vehicles on HOA property. Towing the vehicle removes the unwanted vehicle – booting only leaves the vehicle there with a boot on it. And, BTW, I agree – I wouldn’t be concerned about the cost to the offender. They made the decision to park in a no parking area, so they need to live with the consequences of their action.
