One of the problems of our community is lack of parking and in spite of this, some homeowners occasionally wish to convert their garage to a room which is forbidden by the by-laws which state that the garage can only be used to garage and for incidental storage and my not be converted.

When I saw a cement truck pull up to a house I knew something was up and suspected that a garage conversion was in process so I knocked on the door and informed him that it was against the by-laws. He claimed that he spoke to the president of the BOD who said it was OK. He also put me on the phone with his wife who spoke to the management company and was told that it was OK to convert the garage.

I called the president and he claimed that he did not tell them it was OK and he was going to ask the management company to send them a letter. However, I believe the homeowner; I believe that both the president and management company said that it was OK to do.

Later the president said that the homeowner was not going to convert the garage, just pour cement to level it and then entertain guests there. But when I spoke to the homeowner he did not deny that he was not converting his garage. Days later I saw a home improvement truck in the driveway, 2x4s on the lawn, a light fixture box, and heard hammering from inside the "garage." When I asked the management company for a copy of the letter that they had supposedly sent, I received nothing.

Naturally, the homeowner has a car on the packed street and nothing is being done. They all want to cover their ***.

We allowed owners to expand into their garages. There was 1 very big hitch to it. They could NOT change out the garage door. The outside appearance had to stay the same. They also had to get approval to change out the garage door to one that would support their project changes. Garage doors aren't very well insulated. They still had to park in their driveway.

I would venture to say this may be what this homeowner may be doing. He may not be changing the outside appearance of the home. It's just he's closing up the garage area for expansion.

Does the HO in question have a posted building permit?

If not, contact code compliance ... converting a garage to living space is VERY expensive!

And also normally affects their property taxes!

Read your ByLaws and CC&Rs. Most HOAs require a owner to submit an architectual change request form. And that form should be submitted to the board for review and compliance. And if approved, is kept on record for future reference.
If this is the case, request a copy of the request and it's approval.
