We have several boardmembers who continually violate the ccr's by parking rv's/campers in driveways for longer than allowed. Also conduct yardwaste burns in their yards,prohibited. Allow some other homeowners/neighbors to "skirt" the law regarding sheds. The Board protects itself, using assoc attorney, to send strongly worded letters akin "to how dare you question the board". Is there an attorney who can help get these boardmembers removed and/or made to pay fines for violations just like the rest of us must pay? Thanks

Just vote them out. You dont need a lawyer to do that.

Mail an anonymous letter to every homeowner listing all of their violations and failure to send a fine to themselves. See if they get re-elected.

Thanks for the reply. A little easier said than done since the assoc atty is a good friend of a boardmember and he uses the atty to suppress any "opposition". I have photos of the violations, taken from the street, but do not know if Illinois laws will allow me to show them. I'm sure the assoc attorney will send me another strongly worded letter suggesting I refrain from taking any action, such as releasing the photos, throughout the development. Any thoughts, anyone?

Please don't do anonymous letters or postings. That could turn against you. I would think a petition would be a good way to start with. If you can get the violations well documented and enough signatures required to support your claim than I would not worry about that attorney at all. In fact, he should worry.
If the BOD removal is your goal you have to follow whatever the docs/law say.

Ignore strongly worded letters. They weigh the same as weakly worded ones, and have the same power.

Vote them out.

Show your pictures and send letters to the neighbors. Keep with facts, and only facts (the ultimate defense against libel and slander is TRUTH). Make no slanderous statements, make no embellishments, just copy the Rule/Regulation, the violation noted, date, time, and any response, and keep sending and talking.

Vote them out

Learn to laugh at the lawyers. They don't like it, but it's fun. Laugh straight in their face some day, it's empowering.

Oh, and vote the board out at the next election.
