We have a home in our association that is currently rented to an individual.The owner of the property lives out of state.We just discovered that the individual renting the home has placed an ad in one of our local newspapers seeking to sublet one of the bedrooms to another person. Our community is zoned as single family detached homes only. I recently spoke to an officer at the county board of planning and zoning concerning the definition and restrictions of a single family home. He stated that there were no limits to the amount of people residing in a single family home other than the restriction that they must be family members with a limit of one other non family member. I'll have to make an appointment to see him again regarding the issue of a renter subleasing a bedroom. There are no restrictions in our Covenants or By Laws other than a statement that we are a single family community. I feel this is improper and will devalue our homes. Any thoughts or solutions?

Since there is nothing in your governing documents preventing this action and it appears that this action is not conflicting with any laws, I believe that this leaves you with the following options:

1) Contact the owner of the property (as they may be unaware of the sublet and it might be violating the lease)
2) Verify that the issue doesn't break any State/County/City laws (which you are already doing)
3) Suggest a change to the governing documents.
4) live with it and hope for the best (as a single sublet might not have any adverse affect at all).
