Does anyone know if a petition for a special meeting needs to be notarized or it is ok if only the person who collected the signatures (affiant) sign it? Thanks

Ali,

"720:306 Special Meetings: "(3) SPECIAL MEETINGS.—Special meetings must be held when called by the board of directors or, unless a different percentage is stated in the governing documents, by at least 10 percent of the total voting interests of the association. Business conducted at a special meeting is limited to the purposes described in the notice of the meeting.
You need not notorize them but should send them by registered, return receipt to the Board.

Ali,

it really does not matter whether a special meeting is called by the BOD or members. Unless your By-laws describe specific procedures for giving the Notice you should follow the statute and yes, the 14 day notice and affidavit would be required. I am not quite sure what you mean by notarizing the petition itself.

Donna, I can't find any requirement in Chapter 720 that Notice describing the purpose of special meeting must be mailed registered. Can you please clarify?
