Im wondering can I as a landlord thats currently renting out of one of my homes make HOA a utility for the tenant to pay

I shouldn't think so. Your state likely defines what a utility is and regulates them. I bet your HOA ain't one of them.

Besides, your CCRs are technically a contract beyween you (as well as the other homeowners) and the association and you can't assign that contract to someone else. If your tenant fails to pay, the association is still going to come after you.

I don't see why you could not write into a lease that the tenant must pay the HOA.

HOWEVER this would not change the fact that you are responsible for paying. Since the consequences of being late are additional fees and potentially a lien, it seems to be a rather bad idea.

Besides the HOA fees are fixed (just add it to the rent). The reason for making a tenant pay for utilities is that the usage largely depends on the tenant. Including utilities in the rent encourages the tenant to be wasteful.

Wouldn't this cost be tax deductible to you? I know that as RENTAL property the HOA dues are tax deductible. They are NOT if you are living in the property. The Renter should be paying you and then you pay the HOA. That's who the HOA is going to hold responsible anyways.
