I'm trying to figure out if notices for meetings have to be mailed or is posting on the wedsite and by the mailboxes enough. I'm in Arz. one topic said--

In Arizona, the state open meeting law states "Unless otherwise provided in the articles or bylaws of the association, for meetings of the board of directors that are held after the termination of declarant control of the association, notice to members of meetings of the board of directors shall be given at least forty-eight hours in advance of the meeting by newsletter, conspicuous posting or any other reasonable means as determined by the board of directors."

Is this state law? If so where can I find it? Is 'conspicuous'considered website & bulletin by mailboxes?

Don't worry about the State law. Your documents give you the requirements for your own HOA and that is what you need to follow. (BTW, Arizona law reads the same). Conspicuous is vague but the law requires it to be posted, where is up to the HOA. Do not try to figure out what that means according to the State because you will not come to a conclusion that everyone agrees upon.

put it on the community bulletin board, at the gate or at the mailboxes, or anywhere else that's fairly open, conspicuous, etc..

You don't need to go to great lengths, you just can't hide it on the back of the meter behind the president's house in the alley.

And YES, 48 hours notice is very normal. That is what Florida requires as well. We post ours on the gates with a big velcro held message Board, the website and bulletin boards at the club house and pool. Florida goes further to allow notices to be sent via email but only if the recipient has signed off on that type of delivery.

I would assume "conspicuous" means in any location where they are likely to be easily seen by a majority of your homeowners.

DO NOT place meeting notices IN the mail boxes, or attach the notices to the boxes. That's a federal crime. I would suggest getting one of those portable folding message boards (one of those things that look like a saw horse when opened with a flat surface on each side for posting messages, or with surfaces that can be written on or to which plastic letters can be attached). If the mailboxes are centrally grouped, place one of these at each mailbox location, or, you can place one at each entrance to your development.

Thanks for the info. I knew I could get help here. I didn't mention that this is for a general board meeting that the owners are invited to attend. I've been shown where the CC&Rs state that notices don't need to be giving for those. That's where the confusion was.

To end your confusion, despite what your CC&Rs may say, Arizona law requires that all Board meetings must be posted and open to the membership. The State law trumps your documents on this one.
