My subdivision has an alley behind 2/3 of the lots. The other 1/3 of the lots are located on the periphery of the subdivision and have regular driveways that connect directly to the city streets in front of the lots.

Each limestone-paved alley is labeled "20 ft. servitude of passage, 10 ft. each side" on the subdivision plat. In other words, the developer granted a servitude for an alley that runs across the rear 10 feet of each alley lot.

I live on one of those lots. My lot is 75 ft. wide. That means I own the dirt underneath a 10' x 75' patch of the alley behind my house as do all the other lot owners on my alley.

The alley has an enormous pothole close to my lot. I scrape the bottom of my car driving through it. My question is this: who is responsible for repairing the alley——the lot owner (me) or the HOA?

Hard to tell without reading YOUR CC&R's, who do they say is responsible?

Look again on your plat map.

If the alley is WITHIN your plat, you take care of it.

If it is outside of all plats, then the sub should maintain it.
