The board sent out proxy ballots with only the names of 2 incumbent members and no names of any new candidates. After they were delivered via usps one of the incumbent members decided he did not want to run in the election. Four proxy ballots were sent back in with votes for both incumbent members listed on these ballots.
During our annual HOA election it was brought to the board’s attention that this was not appropriate and new ballots should be sent out to represent the actual candidate pool. They stated if it was a close election new ballot would be sent. Two people were elected and three were tied. One of those was an incumbent. This was announced at the meeting and stated there would be a run off.
The next day one of the candidates was disqualified when they discovered a proxy vote was counted and the resident actually was present and voted.

Is there enough improprieties will this election to request a new election?

Probably not; you have described things accurately and came to a conclusion.

There is always the risk that a candidate could drop out - at any time. When ballots are mailed out ahead of time, voters only have the choice listed on the ballot. They also miss out on nominations from the floor and write-in votes. That's the breaks when people don't come to meetings.

Votes for the withdrawn candidate were not counted. All others resulted in an election and a 3-way tie. I would have encouraged a runoff right there and then.
