Hi,

Here's our neighborhood situation:

1 ) Below occupancy neighborhood for creation of HOA committee (no voting power)

2) 3 banks own remaining land in neighborhood (about 70% total)

3) unmaintained lots and management company does nothing, or cannot do anything.

4) Inferior Management service and inflated dues.

So, knowing most Covenants protect the management company, builders and developers from legal action, what can powerless residents in our situation, do to remedy?

Petition the Banks for proxies to turn HOA over to the membership.

Petition the Courts to have the HOA turned over to the membership.

Be careful what you wish for.

Contact your local code enforcement office, at a minimum they will require the lots to be mowed once a month or do it and bill the owners.
