Can a property owner who is a member of a HOA be hired as a property manager for the HOA. About twenty years ago I lived in a large community 595 units. The HOA was paying one of the residents a salary of $38000 a year to be manager.

Twenty Years ago, the Statutes governing all HOA's in Florida were 617, the Not For Profit Corporation Statutes. If anyone wants to refer to them, you would need to visit the State corporation archives and go thru the microfilm of the old laws. So the answer is, who knows what they said.

All property managers who have more than 50 units must have a current Florida CAM license. It is the law now. The license is renewed every year.

So your question is whether a property owner can also be the property manager. If your Bylaws allow for homeowners to also be employees, then yes they may. I would never vote to allow for that if I were a Board member. This can be a double edged sword for the P.M. and become a conflict between other owners and a P.M trying to deal with enforcement or other tougher issues.. I would never vote for it nor want to do it either.

I would think that as long as the PM is not a member of the Board and no one from the family is elected or appointed to the board then there is not an issue. This of course is with the expectation that the PM holds any necessary licenses, is properly bonded and does satisfactory or above satisfactory work.

I agree that this may cause a perception of impropriety from other members. Therefore, the Board need to keep the membership informed. Perhaps even specifying the amount of savings (if any)and benefits from hiring a resident vs. an outside contractor.

We had and still have a Board member manager. Talk about discontent and problems!!
