From South Florida, as Florida Statutes chapter 720.307 and in connection with Rule 61B-81 to recall one or two Board Director/Officers been turn in at a Board Meeting. (that only require only a 10% of the voting interest). A recall meeting shall be help not less that 10 days nor more that 20 days from the date wehn the notice of the recall meeting is mailed or delivered. And was delivery at a Board Meeting.

Can you tell me if the Board Directors don't wanted to follow the rules. What can we do to enforce the recall?

Recalls are easy if you have 50% +1 (simple majority) of the membership willing to vote FOR it.

Having said that, the process must be follwed EXACTLY to avoid a successful challenge.

The recall will be "enforced" according to the vote.

Are you saying that the board is not calling the meeting? You can understand why.

If they don't hold the meeting within the alloted time, hold your own meeting, conduct the vote and present the results to the board. Be sure you have officers/board in place to take over. So the meeting will be for the recall and an election.

No meeting necessary to serve the BoD a recall.

Use the ballots,

go door-to-door,

follow the instructions CAREFULLY.

Once they have been served they MUST hold a 'certification' meeting within 5 days. IF NOT then the recall is automatically certified.
