We just voted in a new board on June 29; taking back control so to speak........the old board on July 1 turned off the sprinklers to the common area, largely grass; we asked for the combination to the sprinkler timer on July 6.............any recourse?

Get a pair of bolt cutters and cut the lock off- that is a lot cheaper than letting the grass die. If the old outgoing Board has a problem with it, they can take it up with the new Board at the next meeting.

I would suggest sending each of the former board members a certified letter demanding to be given the combination by a certain date. Otherwise the new board will have the timer replaced and they will be billed for the cost, plus the cost to repair any damage to the lawn in the meantime.

Wouldn't that depend on what's stated in the declaration or CCRs? For example, our declaration states homeowners may be charged for damage to common elements. We had one instance where a homeowner didn't like a certain tree in the common area next to his home, so he took it down. He was required to replace it at his expense.

But I agree with the earlier post. Cutting the lock off is the simplest solution.

Cut the lock off. Why would the "new" board want to use the old lock knowing the "old" board had the combination?

Cut the lock off and take back control. It is a common area and the ultimate responsibility falls on the sitting board to take care of it. I am always amazed by board members behaving badly.

Are you on the Board?

If your not on the Board the only thing you can do is contact the current board.

If you are on the new Board, then the earlier suggestions would be applicable.
