Please Help!

I have a neighbor who is using code enforcement excessively (25 complaints in 5 months)
all complaints have been given a completion no violations, but this homeowner is in
close proximity to me and has something against me. I am on the board and they take
photos of my cars and photos of different instances of things we do the homeowner thinks
they are right but the county says it is harassment and they will not do anything!!

Help!!

It's probably because you are a board member...Your position of board now supercedes you being human. Don't ask me why, but now that your in a position in the HOA, people don't view you as a neighbor but the HOA itself. So what the neighbor is doing isn't personal as much as it is to the "HOA".

Once you understand this concept, you may be able to approach the situation differently. Don't use your board powers of course unless it's a HOA matter. Just understand this person may not view you as a person but an entity. They take pictures and complain as a way to say "Hey looky here what our board member does and you want us to conform when xx doesn't???" Just take the approach of there is a line between when you are a board member and when you are a neighbor...If they don't know where that line is, then it's their problem not yours.

That is good advice but it has gotten worse, I have the
attorney involved, He will help me out, he has connections
in the county and hopefully this can subside. I am just tired
they come to my door and sometime they are nasty and they gave
me a photo that this person too as proof! Do they not have a life!
how does this help the community, oh this homeowner was a president
for many years too!

Gives me an idea- remember the movie 'Miracle on 34th Street'?

At the end the Judge makes a great ruling..."If the United States Post Office, an official branch of the United States Government declares this man to be Santa Clause, this Court will not dispute it."

How about sending the guy a letter saying: "If the County of (insert name of county) deems all your complaints to be harassment, then this Board will not dispute that!"

Then stop opening his letters or just return to sender.

When you say "code enforcement", what code? Are you talking about HOA restrictions? Codes are County regulations normally. I want to know what you mean and why the County would be involved in harassment issues between 2 people.

Them ex-presidents....They never get over their job...LOL!!! There's a line between HOA member and HOA enforcement and Human being law. This person needs to have the police called in when they come to your door uninvited. Restraining order may be too difficult to have in your situation. However, they are possible with limiting your proximity with them.

Just tell them their lawyer needs to talk to my lawywer...Usually they don't have a lawyer...I understand what your going through as I also have a bad neighbor next door to me. We aren't in a HOA though. I just got put up a 6 foot privacy fence between us...Fences do make the best neighbors...

I am afraid you are right this person has gone after my other board members also, long story!!!
I had to get the HOA attorney on it because he is the contact and he is tired of it too!! Fences
have no boundary this person has taken photos over the fences goes across the street and takes photos
of my home etc... I think maybe they do it to upset me, but you never know, they also take photos
of kids in the street to prove a point that children are playing outstide etc... I can go on and on..

The county code not HOA codes, the county has to come out no matter how stupid how many
times a person reports something. I understand it is their job but none of these
issues have lead to anything they are frivolous and stupid. It is a waste of my time
and the county's but they are getting tired of this person, maybe they will reprimand
them. The issue and photographic evidence is the same over and over again. Anyone can
say anything and lie and report it, but they are getting angry and so am I!! This
person call the county when I put a garage sale sign on the right of way over the weekend
it was gone of course by the time they came but I have to got the county to get these
papers or reports to see what he is up to, this is monthly, other times it is parking
and other times it is so stupid I do not even want to type it! I thin I need to get
an attorney involved!

Oh this is all from the same person and was also the previous president of the board.

You have a problem with a former Board member. This person may be a little wacko OR they might have an issue with you, maybe like putting up a "garage sale" sign. Maybe the no tresspassing sign. Maybe they are trying to prove that you are breaking the no sign regulation that your HOA has.

I am not trying to be a smart butt, however I see stupid childish behavior on both of your parts. Excessivly calling the police will result in your getting charged or the other person or whoever is constantly calling. The Police will tollerate this for just so long and then you will be warned to resolve this by yourselves. You said that this person was taking pictures of your house from across the street and then you post sign pictures here. Is the goose and gander saying not applicable?

They are code officers for the county. The reports are the complaints the county will not give them to you
and they do not mail them to you, they come out and if they see a violation they either talk with you
or send a letter. I can go to the county and request all complaints made and they must give them to me, the complaints
say who the person was who made the complaint and what they wrote too. The police is another matter last month they
came out here no due to me 4 times, complaints made by this same person.

The issues are not fined I do not get a fine because their is nothing to find when the officer for code enforcement
comes out. But this person is taking photos of things on the weekends like a garage sale for example complains
and when they come out to me on Monday the sign is not their. Waste of time and the officer is annoyed etc..

No the sign is on our property and those who have it have permission from the HOA. I cannot say details but
this has happened again this weekend. The code or county does not come out on the weekends, but they have taken
photos and accuse me of putting it out which I have occasionally put on the right of way on the weekends though.
In fact the code enforcement officer and manager said to do this because if would not effect them and then move
it on your property during the week. So I did this, should I just ignore the visits? or get an attorney involved?

Once other thing I have never called the police nor code on anyone, this is all from one person one sided. I am
getting harassed not the other way around!! all the time, same homeowner. And again we have persmission for this sign from HOA

Why would you use an alias on this forum? That is very troubling.

By your own admission you are guilty of violating the sign ordinance restriction by putting the signs in the right of way. You are not being accused, you have been OBSERVED violating the ordinance.

You may not use association funds for your own personal use. The violations are against the homeowner and not the President of the association.

It's very simple. If you are tired of them coming to your door, then don't violate the ordinances. You are not above the law. Every resident has a right to complain to the County about a violation and there is no such thing as "excessive complaints". Whether it is the sign ordinance or the no on-street parking ordinance you must comply or face the consequences.

The fact that your neighbor has evidence that you are in violation and that you have no evidence that they are harassing you, speaks volumes.

It's funny how you believe you have the right to complaints made against you but refuse to give your association members access to complaint letters. That is hypocritical.

There is nothing worse than a Board member who thinks they are above the association laws and now the County law.

And by the way this is the SAME person who doesn't want to approve a No Trespassing sign which is a requirement of the Florida Statute.

This is no turf war but another revelation about the dishonesty of this Board. Even with my experience with the deception of this Board, I am flabbergasted at what has transpired. There is simply nothing to view or ask on this post.

I will no longer respond to this post but I respectfully request that PennyK not use duplicate usernames any more.

Here is further proof that this person is NOT who they claim to be in the form of a picture of the garage sale sign in the right of way.
