I am from California.
A former director is giving out all our members phone numbers to various places and we are getting annoying phone calls. I understand he was able to access the numbers as a director but since he is no longer a director, is there a way to stop him from giving out our unlisted cell phone numbers. I realize there is no law prohibiting an individual from disclosing another persons cell phone number but since he was a former director, and he obtained our numbers when he was a director, is there some law that prohibits/limits him from doing this? Thanks a lot.

You bring up a great question, and I would think it this should also concern home addresses and emails. Once upon a time, our association published the phone numbers of board members in the newsletter. That was before my time and when I moved here, that had changed to publishing each homeowner's address.

Today, we publish individual emails, although I will be proposing that the board resume using one email address for correspondence. Not only are there issues with being able to enjoy one's home in peace, we live in a society with truly twisted people and I'd hate for someone to publish personal information to the entire community because he or she was pissed off about one thing or another.

At this point, the best thing I can suggest is that you send him a letter advising him that personal numbers (cell, work, home, etc.) of current - and former - board members are not to be given out to anyone without that person's permission and he needs to stop what he's doing RIGHT NOW> Better yet, prepare a board resolution to this effect so all homeowners may be told.

That is a good suggestions but cell phone numbers are public and anyone can give them out. However, I was wondering if there was a law in CA that makes it so even directors out of office have to keep their fiduciary duty of confidentiality. A director in office cannot give out phone numbers but he is now not part of the board. But the numbers were attained when he was in office. It seems like there should be a law that makes it so even directors who are not in office have to keep confidential the information they had access to as a director but I have yet to find it in the civil or corporations code. Thanks

The number is already out. There is nothing you can do to change that. Just change your cell number and dont give it out anymore.

Is there any indication as to WHY the former director was releasing phone numbers?
