We recently moved into a HOA, and the main road infront of our house has gigantic potholes.
I contacted the developer whom I thought was actually the president, however he is not. The gentleman said he was not sure when the road Would be fixed and that the president did not know either. And I suppose that is what HOA fees are for to maintain the road?
I am not sure how to find a solution to this ongoing problem, cannot really find a clear cut answer in the declarations pages either. I was told that the acting president doesn't really want the position, and I am in need of any advice on where to turn to ensure this problem somehow gets resolved. We have to put rods along our grass so people don't drive upon it to dodge the potholes. Any input would be appreciated.

Your HOA may or may not be responsible for the roads. It would depend on if they are private or public. If they are public then you can contact public works for your city. If they are private, then your dues may go to the repairs. However, keep in mind that a HOA is ONLY funded by it's members for it's members. This project may require a special assessment and majority vote of owners to do. This may be the reason why it's not been done...

Instead of waiting a year or longer, dealing with people who dont want to help, I find the best way to deal with potholes is to grab a shovel and fill them in. Is it my responsibility? No. But it saves car repairs for me and my friends. Often I can get others to pitch in money or help fill in the holes.

I dont use this product, but a similar cold asphalt patch.

Amanda - call your local municipality and complain. They will tell you in no time if that road is private and the HOA is responsible.

Thank you for all of your help; the roads do get filled with this "crush and run" type of thing as my husband calls it. However, once there is a down pour of rain it washes away. This road problem is very confusing for me, as I am aware this is not maintained by the state road, and is maintained by the HOA. I am on one side and another HOA is across from me and from my understanding he dues go toward maintaining the road. My HOA seems to he in a fog about fixing it correctly, and I am a new homeowner here. Hypothetically speaking though, shouldn't someone be able to fix it?

They are just playing dumb. They know how to fix it correctly, its just very expensive. ie; calling a paving company and having them put hot asphalt down properly.

Do you know anything that could be done? Where do I start? The developer of this HOA is not the president, but his daughter is, and neither want the position. Is there another avenue to go with this? Is there some governing person or agency that is over HOA's, or am I just stuck with a yucky road and posts along my yard to prevent others from driving right on my grass to dodge the holes? I am new and don't want to create waves but my goodness it is frustrating to deal with.

Is your HOA still under developer control?

Is the HOA across the street part of your HOA or a different one?

Is the road a shared responsibility between both HOAs or just one (the City/County can help you figure that out)?

We have one such road in our sub - half Association, half county. Of course, since our Members must travel it, we maintain it. The county could care less.

Without knowing anything about your association or who owns the road, I recommend patching it yourself and putting a tar sealer over the top before it rains so it doesn't leave a hole again. Otherwise, start getting involved with your HOA and maybe even become president. If you dont do it, who will? No one. Where are your dues going? Why are the potholes not being repaired...... get involved.

There is no state/local/federal agency looking over your HOA. If something needs to be done and isnt, you would have to sue and use the courts to force a HOA into action. Your pretty much on your own.

Although this kind of road repair isn't hard to do by any stretch of the imagination. I would not recommend doing this work yourself due to liability issues.
