I know that some of the condo units are being rented out(by out-of-state owners, and/or Internet companies hired by owners) by the week and even week-ends. This is completely against the CC&Rs. Who these people are, however, we do not know for sure. One out-of-state owner who owns two condo units (that we do know of) claims that they are friends of theirs and not being rented by strangers. We know this to be untrue. The problem is....HOW is the best way to get ahold of this problem? Usually individuals coming in for he weekend or even a week are not always prudent in their use of any of the amenities at the condo complex. Why should they be... they are here today and gone tomorrow. Any suggestions on a strategic way to handle this delicate situation?

If the property is listed with a realtor or vacation internet company, a copy of the listing would be the proof needed. Then just enforce the covenants per your enforcement policy.

If the property is not listed, it will be much more difficult to prove that they aren't friends, relatives, etc..

One of the problems is that the rental agency (Internet) will not mention which unit until a contract is signed for the weekend
and money received by them.

If it were worth your time and money, you could always pose as a renter (or have someone pose) , rent for a weekend, and have absolute proof in your hands: a signed contract for that unit, signed by the owners/agents.

The big question is: Does your HOA have legal remedies to apply after you get that proof?

If you know which units are being rented on this basis, contact the Division of Hotels and Restaurants. I can almost guarantee that these types of rentals will have more stringent guidelines and tax rates.

The Bed Tax differs from County to County. Go to your County Tax department and they will connect you to the correct department. My Florida County back in 2000 was collecting 6% on the rent on short term rents collected. That is why you see so many long term leases in certain areas of Florida. I believe that leases longer than 90 days are exempt from the tax.
