Does anyone know if the CA civil code 712, 713, 1353.6 applied for posting a message on the 8.5 X 11 white paper on the side of the HOA common mail boxes. I read these articles and they seem to be applied only for Sign, Banner, Poster, Flags – NOT the 8.5 x11 white paper.

It was my impression that common mailboxes (if you're referring to the ones in clusters for the neighborhood) are Federal Property and shouldn't be cluttered witttth signs of any store, whether it be banners, posters, etc.... The spirit of the statue would seem to be that white paper of any size is a no-go as well. When I see our clusters riddled with business cards and other visual graffiti, I remove it. Noticed for lost pets or other personal items for a resident will stay for a brief time, but will eventually be taken down. Hopefully the person putting it up has the same respect for their surroundings and taken down too.

What is classified for the message on an 8.5 x11.0 white paper? Should it be governed by the section 1353.6?

California Civil Code Section 1353.6
Legal Research Home > California Laws > Civil Code > California Civil Code Section 1353.6
(a) The governing documents, including the operating rules,
may not prohibit posting or displaying of noncommercial signs,
posters, flags, or banners on or in an owner's separate interest,
except as required for the protection of public health or safety or
if the posting or display would violate a local, state, or federal
law.
(b) For purposes of this section, a noncommercial sign, poster,
flag, or banner may be made of paper, cardboard, cloth, plastic, or
fabric, and may be posted or displayed from the yard, window, door,
balcony, or outside wall of the separate interest, but may not be
made of lights, roofing, siding, paving materials, flora, or
balloons, or any other similar building, landscaping, or decorative
component, or include the painting of architectural surfaces.
(c) An association may prohibit noncommercial signs and posters
that are more than 9 square feet in size and noncommercial flags or
banners that are more than 15 square feet in size.

To me, "on or in an owner's separate interest," seems to me to be on one's private property, no common mailboxes for those are the property of the Federal government, not the HOA and/or homeowner.

Maybe I'm lost on the gist of this thread.............
