My husband and I belong to a little community known as "Horseshoe Bend" in Weatherford Texas. My husband just recently resigned from the board that he had been on for almost two years. Due to several previous board members being voted off they were replaced by several men that are up to know good. Anyways to make a long story short, they stated in there monthly board meeting that we were not allowed to vote among two other couples. We are current on our dues as a matter of fact way current. Are they allowed to keep us from voting?

Tammy: Your voting rights should be clearly specified in your covenants. In ours, every lot owner is a voting member (one per lot), and every voting member can vote if he or she is currently in good standing (meaning current on dues). That's the only requirement. The covenants can only be changed with a 75% vote of all voting members. So if you lived in our HOA and are current on your dues, you would be allowed to vote. To make sure that is the case in your association, check your covenants. Those documents should be filed with your county recorder, that way you can make sure to have the latest official version.

Did you ask why? As a dues paying member (as you stated that you are current in your payments) then there should be no other reason why you cannot vote. Are you or your Husband, the owner of Title?

That will teach you. Dont resign only to be replaced with idiots. The only reason I serve is; I dont want to see my monthly dues go down the drain with people who have no idea what they are doing or have nefarious motives.

Your husband has voting rights as a general Member of the HOA, but no longer as a board member since he is not on the board any more.

You need to ask WHY his voting rights as a Member have been denied.

Was the vote a vote of the board, held at a Board meeting or a vote of the membership, held at a general membership meeting?

There is only one vote per lot/property. So you may not vote as a "couple". Which is what they may be referring to. I know of many HOA's that couples serve on boards and such. It blurs the line between the voting structure.
