Hello
I am a condo owner with HOA and never late on the dues. There has been a roof leak for past 2 years, my ceiling is about to fall and water spots are all over the roof. I had requested repair several times over past 2 years but HOA have just been postponing the repairs. Please let me know what legal route I can follow that will not cost me too much money upfront

For legal advise you will need to consult a local attorney.

Have you contacted your insurance company about the damage? They may be able to assist.

This sounds like an insurance claim on your behalf. I would contact your insurer and deal with them. They may then contact the HOA to get things repaired if it's the Condo's responsibility.

I'd make sure you read your documentation and made sure who's responsibility it is to have the roof repair completed. I would also review your homeowner's insurance policy to see what they cover too. Insurance companies are good at dealing with these type of situations. They have the resources and contacts needed for faster processing.

Tim is right. If this has been going on for 2 years it's time to talk to a lawyer. You should be able to get a lawyer to send a letter to the HOA pointing out their obligations and explaining what will happen next if nothing is done. In my experience, such a letter is very effective.

Call your insurance company, they will know how to deal with the HOA and do it for you.

Thanks members. Unfortunately I didn't get any Homeowner insurance. I am dependent on the huge HOA fee I pay every month to take care of external repairs....any suggestions of a good attorney in Arlington, TX area. Also what specialization of attorney should I look for

It looks like you could be paying the entire bill for the repair. Typically a new roof costs only 2500 - 7000K. It depends on size, repairs, and code regulations. You can reduce that cost by different materials selections. If you want a repair job, I've had some repairs done for as little as 300 dollars. I'd suspect your would be about 1K.

I am giving you those costs to bounce it off the cost of hiring an attorney. You may find the costs about the same but risk doubling it with hiring the attorney just to find out you are responsible for the repairs after all.

You said you are a Condo Owner. Are you self managed, or is there a management company?

The first thing you need to be sure of is – who is responsible for making roof repairs. The Condo Association, or you as a Unit Owner. What do your documents say?

If your Documents say that it is Association responsibility, have you reported the leak in writing? And to whom did you send the letter to?

You also wrote that β€œthey” have been postponing repairs. Do you know why?

I was not required to buy insurance. Maybe it's partially because of being in a condo? The building is covered by the HOA's insurance (I get a statement every year showing what the policy covers).

I think we have to wait to find out what the documents say, but I can't imagine *any* situation where a condo owner would have to pay for the roof. Condos typically have a shared roof, which is why the typically fall under the HOA's responsibility. My HOA Board would probably sure *me* if I tried to get a roof repair done on my own, no matter how long they've been dragging their feet.

Adnan, I'm going to throw my vote in for you to contact the insurance company for the HOA. I imagine they won't be pleased that repairs have not been made in a timely manner.

Yep. They will tell the HOA, get the roof fixed now or we will cancel your policy. Too bad you dont have insurance, its probably only around $100 year for the inside of your condo. Money well spent.
