Here we go again. Just received our annual newsletter and ballots and it appears that democracy is dead. There really no sense of holding an election when there are only one candidate running for each position and the return ballots will be handle by one of the treasure and secretary (whose up for re-election). There was again no nominating committee instead a week and a half notice on the website. Only posted a few days before the dead line. We are suppose to follow Roberts rules and have a judge for the election. Which should mean that the returned ballots are sent to the judge and not the board or treasurer/secretary. Shouldn't this miss handling void out any returned votes? Thanks.

You could send a certified return receipt letter stating that proper legal procedures are not being followed pursuant to Section X in your governing documents. Also, if nothing changes after sending the letter then have a copy of your documents in hand and at the beginning of the meeting voice your concern about the procedure so it can be noted in the meeting minutes. You can read the pertinent information in the documents to everyone and see how they respond.

However, keep in mind that unless others step up to the plate other than those already listed on the current ballot, then it potentially would make no difference in the outcome whether proper procedure is followed or not.
