We had a vote last evening, (The members petitioneed for the meeting.) to vote on an emotionally charged issue.
This morning one of the members asked me to return her ballot to her. I did make a copy gave the copy of the ballot to her.
Does anyone know any reason why someone would want their ballot returned to them??

Either way, you did the right thing in only providing a copy.

I'm more interested in the fact that you could identify their ballot over any other ballot. Why were they marked vs. being secret?

According to NE state law each unit has a certain percentage of vote. The total percentage of all units total 100%. This is the first time since I have lived here that we actually followed state law. We have to have the percentage on the ballots to determine if we have the correct percentage to pass. The members knew these were not totally secret ballots. Since I am secretary, I am responsible for keeping the ballots. But I am only one of 2 people that saw the names. A member of the association helped count.

I would not make this a standard habit for the future. Announce that the ballots are confidential and the property of the HOA after being submitted. If people want "copies", consider making 2-part ballots, where they can keep their own carbon copy.
