How does my HOA become incorporated?

I recently found out that my HOA may not be incoprporated. Is there a way to find out if we are? I have found some places that I can search for the name but I do not know what name to search for.

Because no one on the board knows if we are incorperated I assume we are not, so what are the steps of doing this?

Corey, Go to your Secretary of State website. It should direct you to corporations and you can type in the name of your association to see if it is currently or previously incorporated. The site can also provide info on how to incorporate.

You can find this paperwork to be incorporated at office supply stores such as Staples or Office Depot/Max. It's in the area where the rental agreements are at. There is a CD version and/or just paperwork. The paperwork will have to be filed with the State.

Your HOA can be FOR-Profit or Non-Profit. That is actually determined by the IRS or when you get your Tax ID. Most HOA's are non-profit. It dependent on circumstances the HOA decides is best.

I went to the state website and it was very easy and cheap. It took me about 15 minutes to complete everything and cost me about $75. They even got back to me within about 3 hours.
