----------------------------------------------------------------------------- As a homebuyer, my wife and I sign a sheet of paper when buying our house, stateing that we are buying, and not buying to rent or least the home. I was happy with this issue. KB was building these homes as a look before you buy and once you signed the contract the home was built. No home were built unless they had a buyer. In some cases, the buyer had to back out of the deal, once the home was already completed or still in the process of completion. I understand that this happens, but can KB Homes end up selling the home to someone who had plans to either rent or lease them? Most of our issue with the HOA is with problem of the renters either not knowning about the bylaws and or the HOA rules. What if any recourse is there to the ones who signed that paper? Can the buyer sue KB HOMES for saleing to companies that plan to rent or lease these homes?

My wife and I are looking into that same issue right now. Now.. understand i honestly believe KB was duped. We all saw the nice little couple do a final walk-thru on the house 2 doors down and even had a little girl with them.

less than 24 hours after closing....FOR LEASE. That was months ago and the sign is still there and the yard still has no SOD...just a ton of weeds.

So, yes, we are looking into this aspect with a lawyer.

Kenny, if the Declaration does not prevent rentals there is nothing which can be done just because you signed a paper stating your were not buying with the intent to rent or lease.

Regarding the yard with no sod - just weeds that is probably a violation of the Declaration which should be enforced. The owner should be given a violation notice and be subject to a fine. And if not corrected it can probably be corrected by the Board and all costs assessed to the owner.
