A little town (Ruxton) outside outside of Baltimore has become a flashpoint for a national issue possibly affecting all homeowners and associations and we need your help.

If your HOA meets with the intention of trying to figure out how to violate the civil rights of disabled people,(by trying to prevent them from moving into a home) you are in for a class action civil rights lawsuit.

Since Susan took the time to look at the site and comment, I thought I could take the time as well. Unfortunately the site provided really doesn't give a whole lot of information.

Basically it appears that Sheppard Pratt (based on a google search) is a health care provider specializing in various mental disorders. I gather from the limited information provided on the posters site that this center purchased a property within their HOA for use as a group home. Probably providing out-patient services. However, there is no information provided on what type of group home would be provided.

I agree with Susan, that the HOA is going to have major issues in trying to keep them out.

However, I can also understand the concerns of the residents.

IF the CC&R's specify that no business was to be conducted out of the lots, the HOA might have a case. However, it would be a long costly legal battle probably running into the several hundred of thousand dollars (as appeal after appeal would probably be done). I'm not sure any membership would be willing to pony up the cash for a legal battle with only a 50/50 chance of winning.

I am curious if the membership would be raising a similar fuss if this was a fisher house used for our service members.

Based on the information contained on the above link, I am going to amend my earlier posting as I personally don't think the Association could win a legal battle and if attempted it would be wasting the memberships money.
