We are having some erosion issues with our storm water basins. Is anyone familiar with how the development process works? Our developer went bankrupt prior to the subdivision being completed and the community was never actually properly transitioned to the HOA.

We are wondering if what we have in place is "as designed/approved" or if it might never have actually been finished. As the storm sewer and basins are created, do they typically get inspected by city officials or is it simply assumed that they are designed to the approved plans? Anyone know?

I have the engineering drawings, but can't tell if there's an inspection process too?

First item I recommend is to go to your local city/county planning department. Discuss with them the issue, if they attempt to put burden back on HOA then request all information from them regarding any approvals and/or inspections performed for your subdivision which were required for developer to obtain. Review this information and possibly any planning committee or city minutes around the dates of any approved items.

Here in Va. our developer was required by the county to post a performance bond to guarantee that the storm water ponds were completed and meet all applicable standards. We have transitioned from developer control to homeowner control of the association and the developer is gone. However, the county has not yet released the bonds on the ponds because the developer still has tasks to complete on them. If the developer fails to complete the county required actions, then the county will utilize the funds from the bonds to have the work completed.

Dee, You might check with the city building department . They should have any inspection reports filed. Also try the Michigan DEQ they might be able to give you some guidance.
