My community is very distraught over our new HOA president. The problem is that no one in the community knows how these people became part of the HOA. No one in our community voted for the president, vice president and the rest of the board for that matter. I am wanting to vote him out, but how do I go about doing this? Thanks in advanced!

The collective membership has the most power in an HOA.

The Members can conduct a recall of any board member.

All of the insructions are in your bylaws or other documents.

You must read them.

The fact that you don't know how all these people got in power means that you don't know the ins and outs of your association. Please study them before you take action.

I did read all of my by-laws and contacted a lwayer and the by-laws state that we as a community are to vote who becomes president and vice president. This did not happen so how do we remove the now president? Someone on the board was going to do a petition and go door to door to vote him out.

Is your HOA new?

This group may have been the founding members for the new HOA and were placed there UNTIL the next election.

Have you requested copies of the minutes of the meetings? Call the secretary and ask to view the minutes. That should tell you how these people got where they are.

Again, read the section in your bylaws that tells you how the Council of Unit Owners (all the homeowners) remove a Director. Usually there is a petition to hold a special meeting to remove; the Director is given an opportunity to be heard at this meeting, and then there is a vote, in person or by proxy, to remove the Director.

My community was built in 1998. So the community is very well established. I have spoken with a few original owners and I am actually friends of the secretary. Nothing has been done by the books, so we are trying to figure this all out.

Take a look at www.marylandhomeownersassociation.info for how things are supposed to work according to Maryland law. And CAI, Community Associations Institute has many inexpensive books and pamphlets available that can help you.
