Okay, this is a great site by the way. Have received lots of valuable information in the last few days. So this is what's going on with me. I rent a room out so that I am not living alone. Neighborhood has section 8 apts and lots of stuff going on........so I wasn't sleeping at night and I need to sleep because I work, then I rented a room out and actually love it. NOt alone anymore.

The Board sent a letter accusing me of renting rooms, which how did they know? and said I am running a commercial business and that is against the CC&R's.

Actually, my neighbor runs a wholesale distribution company out of his garage; lots of freight deliveries etc., from 7 am thru 6pm and weekends.

How can I fight this. I need a roommate; I am afraid to be alone at night because of the neighorhood, and I really do like my neighbor.. Help please.

If I were you, I'd stop using that word: renter.

Does this person have a car, and that is the real issue?

Who you have in your own home is your own business. If you have the bedrooms to support another person, then it's no one's business.

Be quiet and let them bring "charges" against you.

P.S. I wonder how many other units have 2 non-related person living in them?

What is the exact wording in your CCR for renting? Also, in the CCR how does it describe the property usage such as (used and occupied for private, single-family dwelling purposes only, and no portion thereof nor any portion of the Common Area shall be used for any commercial purpose whatsoever).

How would they know? Possibly they are just guessing or maybe your room mate said something to another person in the association about renting a room from you in casual conversation.

Do you have an official contract between you and the renter?

I would reply to the letter and ask them to provide proof that you are renting the room. Let them know you have an individual who is now living with you under single-family dwelling purposes which includes sharing meals, quality time together, and utility/grocery expenses. Then see how they respond.

Also, as Susan stated don't use the word renter ... it is your roommate.

@ SusanW1; their car is parked in my garage.....she leaves for work at 7:30am returns 4:00-8:00 pm depending on her schedule.
@ JanetB2; the wording in something re: single family home and no commercial business allowed.
and they don't know anything other than they do watch my place; to the point of getting out of the car and coming up to my courtyard to see who is in my courtyard; and there is no official contract;

my current roommate is actually sharing expenses and we do lots of things together walking; shopping; etc reimburses me with cash.
