During a HOA board meeting, can a discussion be brought up on a subject related to a home owner ( myself) and a conflict of interest that I have with the management Company? I wanted to address the board as I feel the management Company was not clear on my point and has not truly represented my point of view to the HOA members. I was refused. They may be correct but just wanted to ask.

Richard, the following is from CCIOA:
"NOTWITHSTANDING ANY PROVISION IN THE DECLARATION, BYLAWS, OR OTHER DOCUMENTS TO THE CONTRARY, ALL MEETINGS OF THE ASSOCIATION AND BOARD OF DIRECTORS ARE OPEN TO EVERY UNIT OWNER OF THE ASSOCIATION, OR TO ANY PERSON DESIGNATED BY A UNIT OWNER IN WRITING AS THE UNIT OWNER'S REPRESENTATIVE, AND ALL UNIT OWNERS OR DESIGNATED REPRESENTATIVES SO DESIRING SHALL BE PERMITTED TO ATTEND, LISTEN, AND SPEAK AT AN APPROPRIATE TIME DURING THE DELIBERATIONS AND PROCEEDINGS; EXCEPT THAT, FOR REGULAR AND SPECIAL MEETINGS OF THE BOARD, UNIT OWNERS WHO ARE NOT BOARD MEMBERS MAY NOT PARTICIPATE IN ANY DELIBERATION OR DISCUSSION UNLESS EXPRESSLY SO AUTHORIZED BY A VOTE OF THE MAJORITY OF A QUORUM OF THE BOARD."

Agendas which I prepare for HOA's always start with an open session for homeowners. I think it was NOT appropriate for the Board to refuse to let you speak for a couple of minutes.

WHO refused your request to be placed on the agenda and be allowed to present your concern?

Did you get that in writing?

Get on the agenda at the next meeting.

Don't try to "solve" the problem at that time. Instead, ask the board to assign you a board member liaison or committee who will hear your concerns on a one-on-one basis. That person can then bring the issue to the board OR the issue will be deemed otherwise (compromised decision, dropped, unsolveable, solved, or needs further discussion.)
