We had our annual meeting a few days ago and we did not have a quorum. We needed approximately 5 or 6 more people to get that quorum. So several homeowners left the meeting and went into the community to get proxies. We mailed out pertinent information about the annual meeting and the proxies should have been sent to the management company in charge. Did we have a valid quorum?

Typically proxy forms are sent to the Association but they do not have to be. Proxy forms identify who the members representative is. These forms can be presented to the Association at the actual meeting. The Association may only reject a proxy if the member is not allowed to vote or the Association has good faith that the proxy form was forged.

Therefore, for members to go out and gather other members or their proxies is perfectly legal and actually very common in Associations that are only a few members short in having the required numbers.
