In California can a homeowner association require homeowners to provide vehicle registration information if cars are parked in private garages. This is a non-gated community. They are threatening to remove pool rights.

it depends in part on what your CC&R's state. Does the contract you signed say that you will?

This was something the board just added. Been in the house for 4 years.

If it is in the CC&R's as Brian posted or a properly enacted amendment or rule then yes they can.

The HOA request for information on what vehicle is parked in the garages is just an attempt to protect everyone in the HOA. Think of this.....If you own a red car and have parked in your garage, and 1 night they see an old blue car inside, someone might be alerted that this is not who should be there? Yes the association can create a rule stating that the members of the community will be required to register their vehicles. That is of course is if the Board does have such rights per your governing documents. You are ungated so I give them some credit for trying to make the community safer, maybe just a little.

They are potentially asking for this information in order to determine how many vehicles each homeowner has in their possession. They then would know how many vehicles are parked in the garage vs. parked on driveway.

As both Brian and Glen stated this would depend on whether your documents have anything stating that this information is to be supplied to HOA. If the documents do not state that it must be supplied to HOA, then they should not take away privileges as it is something that potentially could not be enforced.
