Our developer still has majority control of our HOA because the required amount of lots have not been sold that would turn the control over to the homeowners. The developer has appointed non-property owners to the board. Is this a commonly-accepted practice? Does it appear to be a problem in the making?

It is common … the developer will have his own business associates as initial board members. However, pay close attention to your state statutes for your HOA and your governing documents in determining when homeowners are to receive positions and eventually take control.

Sometimes state statutes will supersede, so do not always believe every little thing the developer has put in your association documents. Take this initial time period to really read through the association documents and your State Statutes regarding HOA’s so you will be prepared.
