Our Declaration states that the monthly assesment fees covers the trash pickup. The developer (who is still in charge of the association) wants to lower the assesment fees ($14.00) and have each owner pay their own trash fees. Trash hauler has no problem with that idea. Personally I am in favor of it. Why,because one owner is behind on fees but is still receiving trash pickup. The developer is not sure if he could legaly stop the pickup under the present system. We have never had a meeting or a vote on anything. Never had a problem to vote on. Other owners said they would not mind the change. Question is, can we do it without having to pay a lawyer? Your thoughts please.

The Declaration would have to be amended to remove the section about trash pickup. The number of votes required to amend it would be contained in the document.

A meeting needs to be called about this. It's also possible, if your still under Developer control, that the developer has enough votes to have the issue pass. However, a meeting still needs to be called.
