We have a developer that is finishing out the PUD and NOW decides he wants to add on and additional 500 homes buy purchasing land that he wants to annex to ours. He will not add any amentities. Whic governing body can we go to prevent this action.

You can try your local Zoning Board but chances are - buried somewhere in your CC&R's is an Annexation Clause designed to allow him to do it.

You can also go to your city council meeting if it's in the city. The city usually approves/disapproves things like this. However, it looks there's not much you can do since it's a "free enterprise" situation...

He can add on anything he wants. Whether or not your HOA gets impacted will depend on how you can prove future ownership of your common areas and amenities.

Be sure to attend all zoning and building requests and get your contract paperwork in order in case he starts to pull a fast one. A real complication will be entrances and roads.

Somewhere if you read your governing documents very carefully, you most likely will find wording where the Developer can add on additional property. The original PUD may not even have the ability to expand the developement but that does not matter. Only your County or township has the right and ability to approve growth. UNLESS!!!!

Where are you located? Some areas are environmental sensitive and might need the State involed. On the side of the mountain where I live, some jacko started clearing trees on a very steep grade for potential sale to a developer. I called Water Quality for the State and he was forced to stop the clearing. Reason? Water runoff into a large stream below which was pouring sludge and soil into the waterway. Tn is very environmentally concious so look at that type of angle.

Good one Donna … it can pay to think outside the box.

Jo … he will need to get approval through both the local government planning and then final approval through the government council. How many people can you generate who will be willing to attend these meetings faithfully and make waves? If you have large numbers show up consistently and speak during the open portions … at some point they may listen. However, on the other side if you start not showing up and no longer beating that drum … then you potentially no longer care.

Are you against the new subdivision OR are you just against having it annex to yours?
