I have a huge crack in front of my sidewalk. My Plat shows that my property ends 2 feet prior to the sidewalk. I have spoken with my archetectual committee and they say it is my responsibility because it is easement. The HOA is responible for the roads, why wouldn't they be responsible for the sidewalk? It is not on my property and it doesn't show that there is any easement?

Hi Mary:

This will be predominantly information from your governing documents and which we cannot see or read. You might check with your local government planning and see what they state with regards to the road and sidewalk maintenance. They may have something on file as to who exactly is to maintain these areas. Also, double check your documents and see if there is any reference at all regarding maintenance of sidewalks.

Thanks Janet. The documents state that we must maintain sidewalks on our Property and that our Property is defined on our Plat. This is a gated community, but I would think that if it wasn't then the County would be maintaining the sidewalks. The HOA and the ACC believe that the sidewalks are on our Property as easement, but it doesn't show that on the Plat. They can take me to court for this.....
